Are OER materials protected by copyright?

Yes. Unless the creator has placed their work directly in the Public Domain, OER works are still protected by copyright. The open license chosen by the creator will tell you what you are allowed to do with the work, such as editing or distributing. Anything beyond those permissions, such as taking credit for a work, is a violation of copyright.
